VaultMyPhone Terms & Conditions

These Terms govern your use of the VaultMyPhone website, customer portal, Android application and backup/restore services provided by Vault My Phone. By creating an account, purchasing a plan or using VaultMyPhone, you agree to these Terms.
1. The service
VaultMyPhone provides cloud-based mobile-device backup and restore functionality. Depending on device permissions, Android restrictions and your selected settings, supported backup sources may include contacts, SMS, MMS, call history, photos, videos and selected files. Features may vary by Android version, device manufacturer, Google Play policy, plan and technical availability.
2. Accounts and security
You must provide accurate account information, keep your password and recovery information secure, and promptly notify us of suspected unauthorised access. You are responsible for activity performed through your account unless caused by our failure to exercise reasonable care.
You must only back up devices and content that you own or are authorised to access and store.
3. Recovery keys and encrypted backups
You are responsible for safely storing any recovery key or recovery information supplied to you. We recommend keeping it somewhere separate from the backed-up phone.
4. Plans, storage and device limits
Your plan determines applicable storage, device and feature limits. You must not deliberately bypass those limits. If you exceed a plan limit, VaultMyPhone may prevent additional backups until you reduce usage or change plan. We may change plan features or pricing prospectively, subject to applicable law and any notice required.
5. Subscriptions, billing and automatic renewal
Subscriptions are administered by VaultMyPhone. If automatic renewal is enabled and you have supplied an eligible saved payment method, VaultMyPhone may instruct its payment processor to charge a renewal invoice when it becomes due. You can disable automatic renewal through the available account controls, subject to any changes taking effect before the next processing date.
Prices, billing cycles, applicable taxes and discounts are shown during purchase or in your account. Promo codes are subject to their stated eligibility, expiry and redemption limits.
6. Failed payments, suspension and cancellation
If a payment fails, we may retry it, request updated payment details, restrict new backups or suspend affected paid features after any applicable grace period. Cancellation stops future renewal according to the cancellation terms shown in your account but does not automatically entitle you to a refund for a period already supplied.
7. Refunds and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including any rights you may have under the Australian Consumer Law. Any voluntary refund policy we offer operates in addition to those rights.
8. Acceptable use
You must not use VaultMyPhone to store or transmit content unlawfully; infringe another person's rights; gain unauthorised access to a device or account; distribute malware; interfere with the service; abuse APIs or storage systems; circumvent quotas or security controls; or use the service in a way that creates unreasonable security, legal or infrastructure risk.
9. Availability and backup responsibility
We aim to provide a reliable service but cannot promise uninterrupted or error-free operation. Mobile devices, operating-system restrictions, permissions, network failures, storage limits and third-party infrastructure can affect backups.
You should not rely on VaultMyPhone as the sole copy of irreplaceable information. You remain responsible for checking that backups complete successfully and for maintaining additional copies of critical information where appropriate.
10. Restore limitations
Restoring certain Android data may require additional permissions, temporary default-app roles or actions by you. Android or device-manufacturer restrictions can prevent some content from being restored exactly as it originally appeared. We do not guarantee that every backed-up data type can be restored to every device or Android version.
11. Intellectual property
VaultMyPhone software, branding, website content and service technology are owned by us or our licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, non-exclusive right to use the service for its intended purpose while your account is authorised.
12. Your content
You retain ownership of content you back up. You give us the limited rights necessary to receive, store, transmit, process and return that content solely to operate, secure and support the service and comply with law.
13. Privacy
Our Privacy Policy explains how VaultMyPhone handles personal information and backup data. It forms an important part of your use of the service.
14. Account deletion and data removal
You can request account deletion through the app or our public deletion page. We will process associated data deletion subject to lawful retention requirements. Deleting an account is different from merely cancelling automatic renewal.
15. Liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable. Any limitation in these Terms applies only to the extent permitted by applicable law and does not exclude non-excludable statutory guarantees or remedies.
16. Changes to the service or Terms
We may update the service or these Terms. Material changes will be communicated where required by law. Continued use after an effective change may constitute acceptance where legally permitted. If you do not accept a change, you may stop using the service and cancel your subscription.
17. Governing law
Unless mandatory consumer law requires otherwise, these Terms are governed by the laws applicable in South Australia, Australia, and disputes may be brought before courts with jurisdiction there.
